On Wednesday, the Supreme Court heard oral arguments in Dobbs v Jackson Women’s Health Organization, one of the most important cases to come before the Court in a generation, which has the potential to overturn Roe v Wade and have a nationwide impact on women’s reproductive rights.
According to Aron Solomon, chief legal analyst for Esquire Digital, who has extensively provided commentary on Dobbs, “In a detailed and spirited oral argument today, lawyers for both sides ran up against the brick wall that is stare decisis (the legal concept that we should stand by things already decided).
This concept presents an especially high bar in this case outlawing virtually all abortions after 15 weeks in Mississippi because Casey rejected every possible reason for overturning Roe v. Wade, the law of the land for the last half-century.
While it appears from the tone and content of the argument that this wasn’t a stellar day for the State of Mississippi, the Supreme Court will essentially need to decide whether abortion law in the United States will be solidified for generations or made more unstable in a decision that is unlikely to completely overturn Roe and Casey.”
